The sudden death of the wife of our member and colleague in the pen fraternity came with such a rude shock with no fore-knowledge of her ill-health.

SERAP wants court to stop Buhari from spending N26bn on travels, meals, others
Socio-Economic Rights and Accountability Project (SERAP) has filed a lawsuit asking the Federal High Court in Abuja to “stop President Muhammadu Buhari from spending N26bn in the 2022 presidency budget on local and foreign travels, meals and refreshments, ‘sitting allowance’, ‘welfare package’, and office building.”
In the suit number FHC/ABJ/CS/1361/2021 filed last Friday, SERAP is seeking: “an order of mandamus to direct and compel President Buhari to cut the N26bn presidency budget on local and foreign travels, meals and refreshments, and to send a supplementary appropriation bill to the National Assembly to reflect the reduction.”
SERAP is also seeking “an order of mandamus to direct and compel President Buhari to publish spending details on the State House Medical Center since May 29, 2015 to date; and to redirect some of the money on travels and meals to improve public healthcare facilities across the country.”
SERAP is arguing that, “The government would continue to borrow to fund the country’s budget until there is a substantial cut to the cost of governance. It is in the public interest to stop the government from spending so much money on these items. Persistent borrowing is neither sustainable nor fair to the Nigerian people.”
According to SERAP, “The huge spending by the presidency is neither necessary nor in the public interest, especially in the face of the country’s dire economic position, the scant allocations to education and health, and the growing level of borrowing by the Federal Government to fund the 2022 budget.”
SERAP is also arguing that, “The Buhari administration has constitutional and fiduciary duties to ensure a responsible budget spending, and the well-being and prosperity of Nigerians. Some of the proposed spending could be better allocated to improve access of poor Nigerians to basic public goods and services.”
SERAP is further arguing that, “Any spending of public funds should stay within the limits of constitutional responsibilities, and oath of office by public officers, as well as comply with Chapter 2 of the 1999 Nigerian Constitution [as amended] relating to fundamental objectives and directive principles of state policy.”
SERAP is also arguing that, “Unless the reliefs sought are granted, the Federal Government will continue to benefit from the breach of the law, and the proposed spending of N26bn would leave the poorest and most vulnerable people without access to essential public goods and services, and burden the next generation.”
The suit filed on behalf of SERAP by its lawyers Kolawole Oluwadare and Ms Adelanke Aremo, read in part: “Cutting waste and apparently unnecessary spending would go a long way in addressing the budget deficit and debt problems.”
“Stopping President Buhari from spending the proposed N26bn on travels and meals would ensure that the government is spending the country’s maximum available resources to respect, protect, and promote the rights to basic needs of the poor and marginalized groups.”
“The proposed spending is unsustainable, and would take away critical funding to provide access to quality healthcare and education.”
“Public officers are mere custodians of public records. Nigerians are entitled to know how the commonwealth is being utilized, managed and administered in a democratic setting.”
“According to reports, the proposed N26bn on travels, meals, refreshments and the presidential wing of the State House Clinic is more than the proposed allocations for ongoing and new projects in 14 teaching hospitals combined. N19.17 billion is allocated to the following teaching hospitals: UNILAG Teaching Hospital—N1.69bn; ABU Teaching Hospital—N2.38bn; University College Hospital, Ibadan—N1.49bn; and UNN Teaching Hospital—N1.38bn.”

Identification of bodies continues in Lagos – Commissioner
One more body has been recovered from the site of the collapsed 21-storey building in Ikoyi, Lagos. The body, which was recovered on Saturday, has brought the number of bodies retrieved from the rubble to 43.
There are 15 survivors and 49 persons have reported that their loved ones are missing.
At the Infectious Disease Hospital (IDH), Yaba, the identification of bodies continues.

The ECAM Summit was a side meeting at the sixteenth G20 summit, which was held in Rome on 30-31 October, 2021.
The ECAM Council aims to promote and develop constructive dialogue, new partnerships and strong cooperation between Europe, Africa and the MENA region, with Italy taking on the role as host nation. Mr. Sanwo-Olu joined an open and honest dialogue on such issues as healthcare, education and philanthropically funded projects.

APM CONDEMNS THE IMPOSITION OF N100 DAILY TAX ON POS OPERATORS
WE CALL ON THE AJIF TO CANCEL THE POLICY
The Ajegunle Peoples’ Movement (APM) strongly condemns the imposition of a daily payment of one hundred Naira (N100) on Point of Sale (POS) operators by Ajeromi-Ifelodun Local Government led by Executive Chairman Fatia Ayoola. This is due to the fact that it is exploitative and heartless, and it is intended to rip off POS operators and other small businesses. We hereby call on the POS operators, small and medium scale business owners and artisans to unite to campaign and resist this obnoxious policy.
The statement was made via a circular on the letterhead of Ajeromi-Ifelodun Local Government, without the signature of the local government chairman. The implementation, which will begin on November 8th, 2021, is a case of double taxation, which has pushed numerous artisans, market women and men, street vendors, traders, and small and medium-sized businesses to close their shops.
Already, many small and medium-sized enterprises in Nigeria have collapsed as a result of the difficult business environment, double taxation, and offensive government regulations and policies. This is in addition to the fact that the management of COVID-19 has made life more difficult for many families and people, even graduates, who now rely on the POS as a means of livelihood in the poorly managed Nigerian economy run by the APC, PDP and other bourgeois political parties.
The fraudulent aspect of it is that the local government would be collecting the illegal N100 on a daily basis through designated touts and thugs to whom the POS operators have already paid the yearly corporation tax or lock-up shop (demand notice) on behalf of the local government. Obviously, it is a well-established APC thuggery-style forceful tax collection mechanism throughout Lagos State, and it is in conflict with all relevant sections of the Lagos State Tax Law.
APM, on the other hand, calls on POS operators, artisans, market women and men, traders, street business vendors, and other small and medium businesses to mobilize for a series of mass meetings in order to resist any obnoxious taxes including the current daily N100 and local government policies that are detrimental to their survival.
Finally, APM asks that the order for the daily collection of N100 by the local government be cancelled. Instead, we urge the local government to establish financial assistance programs as well as improvement in public infrastructures like electricity, portable water supply, road, public education and healthcare to assist artisans, traders, market women and men, and other small businesses to survive.

President Muhammadu Buhari has executed the ground-breaking and foundation laying ceremony for the construction of a new Presidential hospital at an event, which held at the Aso Villa in Abuja.
The Chief of Staff to the President, Professor Ibrahim Gambari represented the President and Commander-in-Chief at the event, which was also attended by several key officials of the Presidency including the Permanent Secretary, State House, Umar Tijjani.
Umar Tijjani at the brief ceremony which took place at the project site within the Presidential Villa, said Julius Berger Nigeria Plc, the country’s leading engineering construction company, which had also built the Presidential Villa itself, will construct the new Presidential Clinic, beginning from November 1, 2021, and the projected is to be completed and delivered for commissioning on December 31, 2022.
The Chief of Staff to the President, Professor Ibrahim Gambari who stood in for the President said upon laying the foundation for the hospital: “Now let the construction work begin”.
The Presidential Clinic will cover a total area of 2,700 square meters and it will contain an underground area, two number Operating Theatres, two number Executive Suites, two VIP suites, and isolation centres in the building. There will also be a Laboratory, Healing Garden, Pharmacy and high tech X-ray facility in the hospital when completed.
Umar Tijjani had earlier said, “The project was conceived in 2012 by previous administration and the brief was produced…The President has approved the project. We have gone to Bureau of Public Procurement to get Certificate of No Objection”. He had also said that Julius Berger Nigeria Plc was chosen as the contractor for the project because the reputable construction company built the State House and have been maintaining it since 1990, adding that JBN, as Nigerians generally fondly call the company, has done an impressive work of maintaining the State House.
The new Presidential hospital strategically located inside the Presidential Villa is designed and planned to cater for the medical needs of the First Family and key officials of the Government. According to Umar Tijjani, the hospital will also attend to the medical needs of other African leaders.

NATIONAL YOUTH DAY: YOUTH REMAIN A MAJOR FORCE IN BUILDING A GREATER LAGOS, SANWO-OLU
The Governor of Lagos State, Mr. Babajide Sanwo-Olu has described the youth as a major force in building a greater and sustainable Lagos, as well as a better future for the nation.
He said that the youth segment is an essential key in the development of any nation, because they have the potential and capacity to make change happen for themselves, their communities and for the rest of the world.
In a statement he issued on Monday in commemoration of the National Youth Day, the Governor stressed the importance of youths to building a greater, sustainable Lagos and Nigeria.
Governor Sanwo-Olu explained that the National Youth Day celebration has been set aside to celebrate Nigerian youth and the contributions they make, as well as highlighting issues affecting them with the aim of tackling these issues to support them.
While further revealing that his administration is youth-friendly and inclusive, Sanwo-Olu said: “We have embarked on the implementation of a series of Youth engagements and empowerment activities and programmes through various Ministries, Departments and Agencies (MDAs).
“These youth programmes and initiatives are part of the effort to address issues bothering on youth development and empowerment in the entrepreneurial, agriculture, Information Technology and Leadership skills among other facets of life.”
Governor Sanwo-Olu also noted that his administration has implemented mindset changing and reorientation programmes to build the capacity of young people in Lagos State to think positively and take up their role in nation building.
Some of these programmes according to Governor Sanwo-Olu include the Lagos State Youth Leadership Initiative known as the IBILE Youth Academy, which produced Youth Ambassadors that are already making waves as change makers in their communities, implementing various life touching and empowering pet projects leveraging on local collaboration and resources.
He said: “The Lagos State Employment Trust Fund is supporting young people with great entrepreneurship skills and ideas to establish and nurture their businesses on the path of sustainable growth and profitability.

Governor Sanwo-Olu also revealed that the first Lagos Police Youth Dialogue was recently organised “towards strengthening the relationship between them and creating a synergy that will improve both their interaction and security situation in the State.”
Sanwo-Olu while reaffirming his commitment not to rest his oars in engaging and empowering the teeming youths in the journey towards a Greater Lagos, advised them to utilise their skills and potentials in significantly rebuilding the state and nation for the best of all the citizens.

SERAP sues Buhari, wants court to order recovery of ‘missing N881bn in 367 MDAs’
Socio-Economic Rights and Accountability Project (SERAP) has filed a lawsuit against President Muhammadu Buhari “over his failure to probe allegations that over ₦880bn of public funds are missing from 367 ministries, departments and agencies (MDAs), to ensure the prosecution of those suspected to be responsible, and the recovery of any missing or diverted public funds.”
The suit followed the grim allegations contained in part 2 of the 2018 annual audited report by the Office of the Auditor-General of the Federation that ₦880,894,733,084.811 was spent by 367 MDAs without any appropriation.
In the suit number FHC/ABJ/CS/1281/2021 filed last week at the Federal High Court in Abuja, SERAP is seeking: “an order of mandamus to direct and compel President Buhari to promptly investigate the alleged missing N881bn of public funds, and to ensure the prosecution of those suspected to be responsible, and the full recovery of any missing, mismanaged or diverted public funds.”
In the suit, SERAP is arguing that: “Complying with constitutional requirements and international standards on spending of public funds would ensure effective and efficient management of public resources, and put the country’s wealth and resources to work for the common good of all Nigerians.”
According to SERAP: “It is in the interest of justice to grant this application, as it would improve respect for the rights of Nigerians, and improve their access to essential public goods and services, which ought to be provided by the indicted MDAs.”
SERAP is also arguing that, “President Buhari has a constitutional duty to ensure the investigation and prosecution of allegations of corruption, as well as recovery of any missing public funds. Section 15[5] of the 1999 Nigerian Constitution [as amended], requires the Buhari administration to abolish all corrupt practices and abuse of power.”
SERAP is arguing that, “Granting the reliefs sought would help to address the adverse consequences of unconstitutional and poor management of public resources on the human rights of poor Nigerians.”
SERAP is further arguing that, “The alleged missing public funds have hampered the ability of the indicted MDAs to meet the needs of average citizens, as the missing funds could have helped the government to invest in key public goods and services, and to improve access of Nigerians to these goods and services.”
Joined in the suit as Respondents are the Minister of Justice and Attorney General of the Federation, Abubakar Malami, SAN; and the Minister of Finance, Budget and National Planning, Zainab Ahmed.
The suit filed on behalf of SERAP by its lawyer Kolawole Oluwadare, read in part: “The failure to investigate the allegations of grand corruption contained in part 2 of the 2018 annual audited report constitutes a grave violation of the duty placed on the Nigerian government to take appropriate measures to promote transparency and accountability in the management of public finances.”
“Mandamus is a high prerogative writ which lies to secure the performance of a public duty. It gives command that a duty of a public nature which normally, though not necessarily is imposed by statute but is neglected or refused to be done after due demand, be done.”
“If there is a discretion to perform the duty, the court has the power to examine whether the discretion to refuse to act has been properly exercised.”
“Recovering the alleged missing public funds would reduce the pressure on the Federal Government to borrow more money to fund the budget, enable the authorities to meet the country’s constitutional and international obligations, and reduce the growing level of public debts.”
“These damning revelations suggest a grave violation of the public trust, the Nigerian Constitution of 1999, and international human rights and anti-corruption standards. Spending of public funds without appropriation will create opportunities for corruption.”
“Transparent and accountable public financial management is a key pillar of good governance, and of vital importance to provide public goods and services to citizens, as well as to create and maintain fair and sustainable economic and social conditions in the country.”
“Corruption thrives in contexts that provide opportunities to engage in illicit conduct, widespread motives to take advantage of such opportunities and weak controls.”
“The prevention of corruption is more effective in environments that minimize opportunities, comply with constitutional and international legal requirements and standards, as well as encourage integrity.”
“Section 80(2) of the Nigerian Constitution provides that no money shall be withdrawn from the Consolidated Revenue Fund of the Federation except to meet expenditure that is charged upon the fund by the Constitution or where the issue of the money has been authorized by an Appropriation Act, Supplementary Appropriation Act or an Act passed in pursuance of section 81 of the Constitution.”
“Similarly, articles 5 and 9 of the UN Convention against Corruption to which Nigeria is a state party impose legal obligations on the Buhari administration to ensure proper management of public affairs and public funds, and to promote sound and transparent administration of public affairs and public property.”
No date has been fixed for the hearing of the suit.

PRESIDENT BUHARI TO ATTEND CLIMATE CHANGE CONFERENCE IN GLASGOW; PARTICIPATE IN PARIS PEACE SUMMIT
President Muhammadu Buhari will Sunday, October 31 depart Abuja for Glasgow, Scotland to attend the 26th Conference of Parties (COP26) to the United Nations Framework Convention on Climate Change (UNFCCC).
The President is scheduled to deliver his national statement at the High-Level segment for Heads of State and Government at the conference on Tuesday, November 2.
President Buhari’s address is expected to highlight Nigeria’s key priorities and action to tackle climate change as well as progress on the country’s transition to low carbon economy, consistent with achieving the Paris Climate Agreement.
The conference, hosted by the United Kingdom in partnership with Italy, will bring parties together to help accelerate action towards the Paris Agreement as well as the UN Framework Convention on Climate Change.
Given Nigeria’s leading role in taking climate action and as a signatory to the Paris Agreement, COP 26 will afford a unique opportunity for the Nigerian delegation to work with other parties to make progress on the main goals of the conference including securing global net zero by mid-century and keeping 1.5C within reach; adapting to protect communities and natural habitats as well as mobilising the much needed finances to meet the set targets.
In Glasgow, President Buhari will participate in some side-line events hosted by US President Joe Biden and French President Emmanuel Macron.
The President will be accompanied by the Minister of Foreign Affairs, Geoffrey Onyeama, Minister of State, Environment, Sharon Ikeazor, National Security Adviser, Maj.-Gen. Babagana Monguno (Rtd) and Director-General, National Intelligence Agency, Amb. Ahmed Rufai Abubakar.
President Buhari will thereafter travel to Paris, France on an official visit to reciprocate an earlier one to Nigeria by the French President, Emmanuel Macron, and also attend the Paris Peace forum 2021, the fourth edition to be hosted by the French President.
It will have Heads of State and Government and CEOs of major multinationals, as well as several civil society actors, gathering to advance concrete solutions to the enormous challenges posed by the COVID-19 pandemic, and to improve global governance in times of COVID-19.
The Summit will focus on spurring a more solid and inclusive recovery by addressing the various gaps in global governance, offering initiatives to better tend to the global commons, and putting forward new principles of action for the post-COVID world.
While the President is in Paris, the Nigerian government will organize the Nigeria-Paris Forum. The event is expected to pull a crowd of Nigerian and French investors, government and business leaders, diplomats and the media in the hope of showcasing opportunities on both sides as well as bringing enlightenment to bear on the prevailing security, economic and investment climate in Nigeria.
President Buhari is expected back in the country after the engagements.

This households were reached through the donation of long-lasting insecticidal nets and Guide to Malaria Prevention pamphlets to several primary schools within the states. The beneficiary schools in Kaduna included L.G.E.A Primary School, Dullu Tafa in Kagarku Local Government; LEA Primary School, Kanfanin Zangon Aya in Igabi Local Government and Bashir Abubakar Primary School, Anguwan Dankali in Zaria. In Kano, Sha’iskawa Islamiya Primary School in Garun Malam Local Government and Central Primary School Wak in the Bebeji Local Government Area of the state are some of the schools that benefited. Each school received a total of one thousand long-lasting insecticidal nets paired with a Guide to Malaria Prevention pamphlets.
This recent CSR donations is in continuation of the company’s malaria prevention campaign, which has over the years benefited many communities where it has ongoing projects.

Delta monarch goofed on NDDC forensic audit – South-South leaders

Prominent leaders in the South-South geo-political zone on Thursday said Obukohwo Monday Arthur Whiskey, Ovie of Idjerhe kingdom did not understand the objectives of the Niger Delta Development Commission (NDDC) forensic audit and the recommendations.
They also commended Chief Godswill Akpabio for pursuing key priorities, paving the way to a better future for the people and providing vibrant leadership in the Ministry of Niger Delta Affairs.
In a statement in Asaba, the leaders scolded the Idjerhe monarch for embarking on steps that further present Niger Delta leaders as people supporting corruption and working against the transparency and development agenda of the current administration.
They described the Idjerhe monarch as a divisive element and his recent interview as a shameful exercise.
The leaders praised Akpabio for the redirection of the affairs and profile of the Niger Delta Development Commission (NDDC) and Steps to insure lasting dignity for the Niger Delta people
The statement underscored the reform and re-direction of NDDC, disdain for flippant monarchs, peace, economic growth and empowerment.
Signed by the Chairman of South-South Front (SSF), Chief John Harry, the leaders hailed Akpabio for the reallocation of public spending towards essential infrastructure, security, health and education.
Specifically, the leaders applauded Akpabio for redeeming the zone’s standing, maintaining meaningful dialogue with the stakeholders, strengthening NDDC, increasing transparency, reducing corruption and delivering efficiently basic services to the people.
Meeting under the aegis of South-South Front to address the common problems and interests of the zone, the leaders condemned the Idjerhe monarch for his weak argument, campaign of calumny against President Muhammadu Buhari, Akpabio and the good people of the South-South geo-political zone.
They also criticized the bad sense of language and repetition by the monarch.
